Beginning on Monday, August 7, 2023, the Stark County Sheriff's Office will conduct the sale of all real estate subject to delinquent tax certificate foreclosure on the "Official Public Sheriff's Sale Website", which is operated by Realauction, based on a contract with the Ohio Department of Administrative Services. THESE ARE NOT THE NORMAL MONTHLY TAX DELINQUENT SALES HELD BY THE TREASURER’S OFFICE. The process and procedures under which these sales will be completed are detailed at the Realauction website https://stark.sheriffsaleauction.ohio.gov. All prospective bidders should familiarize themselves with this new process.

In general, the following key points are noted:

  1. All person(s) who want to bid on a property offered by the Stark County Sheriff's Office MUST REGISTER with Realauction.

  2. Properties will be open for bid, at least seven (7) days immediately prior to the Date of Sale. This is generally known as a Proxy Bid.

  3. Each Monday at 10:00 a.m., Eastern Time, the online auction will begin. If Monday is a holiday, then the sale will be held on Tuesday. An auction will be conducted for each individual property; however, only one property will be offered/sold at a time. After a property is sold, the next scheduled property sale will begin.

  4. To be a qualified participant, bidders must submit a deposit based on the total deposit requirement ($1,000/$5,000/$10,000 set by law) for all properties on which the bidder wishes to bid by the predefined deadlines. The only acceptable deposit types are wire transfer or ACH. NO cash deposits will be accepted.

    If you have the winning bid on a property you are agreeing to have your deposit sent from Real Auction to the Stark County Sheriff’s Office by ACH Deposit. This deposit along with any other monies collected will be used to pay the court cost, taxes, and money due to the creditor. When the deed is received by the Sheriff from the attorney’s office you will be notified if you owe in additional money for the fees of the transfer and recording of the deed as required by the confirmation of sale. All costs are paid as ordered in the confirmation of sale by the purchaser

    For WIRE TRANSFER: DEPOSITS MUST BE RECEIVED BY 5:00 PM (Eastern Time),TWO (2) business days BEFORE the Monday auction.

    For ACH DEBIT: DEPOSITS MUST BE RECEIVED BY 4:00 PM (Eastern Time), FIVE (5) business days BEFORE the Monday auction. This means the deposited funds MUST BE in the account of Realauction by Wire Transfer or by ACH Debit by that date and time. It is the responsibility of the bidder to plan ahead and allow enough time for their bidding deposits to be received and processed within the timeframes described above.

  5. Plaintiff/Judgement Creditors - if the Judgement Creditor is the purchaser, they shall not be required to make a deposit on the sale. However, Judgement Creditors are required to submit the bidding style choice (pre-sale manage bid or live bid) AND a copy of the court order stating they are the Judgement Creditor on the case they are bidding to Realauction Customer Service (customerservice@realauction.com) at least one (1) business day prior to the sale date. Submission can be done via email or fax. Submission must include the bidder number and user account contact first and last name in the submission.     The remaining balance is due in 30 Calendar days from the date the final entry confirming the sale is received by the Clerk of Courts. The date received shall count as day number one. The Sheriff of Stark County has no legal or statutory authority to grant any extension of payment. ALL SALES ARE AS IS AND PROPERTIES ARE NOT OPEN FOR INSPECTION PRIOR TO SALE, UNLESS NOTED IN THE AD. People may still be living in these homes so you CANNOT trespass on the property until the deed is recorded in the new owner’s name.

    A property is still owned by the property owner, until the confirmation of sale has been filed AND the balance of the purchase price is paid AND the deed is transferred. Prior to this occurring the purchaser has no right to be on the property.

    Understand your bank may say they need an inside appraisal done, this CANNOT be done. It is recommended, purchasers need to have financing in order prior to the sale as you will have only 30 days after the confirmation of sale to pay the balance.

Tax Certificate Foreclosures are not appraised and the PRIVATE ATTORNEY representing the Plaintiff sets the minimum bid. Tax Certificate Foreclosures are advertised for three (3) consecutive weeks, on Thursday, in the Canton Repository before sale date.
