Foreclosure Sales are HELD EVERY MONDAY at the
Stark County Court House starting at 10:00 a.m. If Monday is a holiday then the sale will be held on Tuesday.
The Stark County Court House is located downtown Canton on the North-West corner
of Market and Tuscarawas.
A deposit is required according to the following table, which is due the Sheriff’s Office personnel no later than Noon on the same day of the sale.
• Purchasers shall make sale deposit as follows:
If the appraised value of the property is:
</= $10,000 = Deposit of $2,000.00
>/= $10,001 </= $200,000 = Deposit of $5,000
> $200,001 = Deposit of $10,000
The remaining balance is due in 30 Calendar days from the date the final entry confirming
the sale is received by the Clerk of Courts. The date received shall count as day number one.
The Sheriff of Stark County has no legal or statutory authority to grant any extension of payment.
ALL SALES ARE AS IS AND PROPERTIES ARE NOT OPEN FOR INSPECTION PRIOR TO SALE, UNLESS NOTED IN THE AD.
Appraisals are strictly an outside appraisal. People may still be living in these homes so you CANNOT
trespass on the property until the deed is recorded in the new owner’s name.
Method of Bidding: Bidding is done in person on the day of the sale,
there are NO PHONE BIDS, NO MAIL IN BIDS, AND NO ONLINE BIDS. (with the exception of the plaintiff) All bidding
will be in minimum increments of $100.00.
Method of Payment: The Stark County Sheriff will accept a
Cashier Check or a Certified Check and made Payable to the Stark County Sheriff. NO Personal Checks or cash is accepted.
The properties are appraised by three (3) court appointed appraisers. The
properties are advertised in the Canton Repository for three (3) consecutive
weeks on Thursday before sale date.
A property is still owned by the property owner, until the confirmation of sale
has been filed AND the balance of the purchase price is paid AND the deed is transferred.
Prior to this occurring the purchaser has no right to be on the property.
Understand your bank may say they need an inside appraisal done, this CANNOT be done.
It is recommended, purchasers need to have financing in order prior to the sale
as you will have only 30 days after the confirmation of sale to pay the balance.
The bank owns the mortgage on the property, however
they do not own the property and that is why it's going through Sheriff's Sale.
If the bank buys the property, it is so they can put the deed into their name and then
they can sell the property to recoup their money.
